It is covenanted and
agreed between the parties hereto that the property described above
shall be permanently subject to the following restrictive covenants:
1. No lot in the Read’s
Mill Acres subdivision shall be subdivided.
2.
Only one single-family residential structure, modular, or stick built,
of not less that 1,800 square feet of living space, if two-story, first
floor should have a minimum of 1,200 square feet of living space,
exclusive of basements, garages, breezeways, decks and porches, may be
constructed on any lot.
3. All
residential construction shall be erected on a permanent masonry
foundation. No single or double wide mobile homes/trailers shall be
placed upon the herein described property. Furthermore, all utility
services will be installed underground.
4.
All septic systems and private water systems shall be constructed in
areas designated and/or as may be approved by the Charlotte County
Health Department.
5. No
mercantile or commercial business of any kind or description shall be
conducted on any lot, nor any noxious or offensive trade or activity be
carried on, and this is to be construed to prohibit the operation of
boarding houses, rooming houses and tourist homes. Nothing herein shall
prohibit the owner/occupant of the single-family residential dwelling
from maintaining within the structure, a professional office for his/her
individual home use, nor instructional tutoring in the arts and
scholastic areas.
6. All
buildings, including accessory buildings, must comply with codes and
ordinances set forth by the County of Charlotte. Furthermore, no home
shall have less than a 6/12 roof pitch.
7. It
is the responsibility of each property owner to prevent the development
of any unsanitary or unsightly conditions of structures or ground on the
subject property. All motor vehicles on the herein described property
or parked in the access road thereto must have current license tags and
inspection stickers. No unlicensed or inoperable motor vehicles may be
located or kept on the herein described property.
8. No
swine shall be kept or raised upon the herein described property.
9.
No more than three dogs may be housed outside of the dwelling house
located on the herein described property.
10.
No advertising sign board or posters shall be permitted upon the herein
described property except for one sign that offers the property for sale
or rent, one sign that advertises an occasional yard sale to be held
upon the property, and one sign of a political nature no more than six
square feet in area.
The above covenants shall run with the land and shall be binding upon
the Grantees herein and their respective heirs at law, devisees, assigns
and successors in interest. Invalidation of nay of the above
covenants by legal or administrative action shall in no way effect any
of the other covenants which stall remain in full force and effect. |
